If you are a US founder or operator running a brand that ships consumer goods to French customers — from a US warehouse, via Pan-European FBA, or through any other route — French EPR is a compliance obligation that hits you regardless of how recently you launched in France. This article is the practical, US-founder-oriented checklist.
Pre-flight: do you actually need EPR?
Three diagnostic questions:
- Are your products consumer goods (packaging, electronics, textile, furniture, batteries, toys, sports/DIY, etc.)? Yes → continue.
- Do French consumers receive your products directly from you (your warehouse to their door, FBA in EU to French address, drop-ship to French buyer)? Yes → continue.
- Are you a US legal entity, not a French or EU one? Yes → you need French EPR through a France-established representative.

The compliance checklist for US D2C brands
Step 1 — Identify your EPR streams (Week 0)
Map your catalog against the 10+ French EPR streams. Most US D2C brands fall under at least two:
- Packaging (Citeo): your shipping box, tape, void fill, branded mailer. Applies universally.
- WEEE (Ecosystem / Ecologic): any product with electronic circuitry.
- Batteries (Corepile / Screlec): any embedded battery or sold-as-replacement battery.
- Textile / TLC (Refashion): clothing, household linen, footwear.
- Furniture / DEA (Ecomaison): structural home goods, mattresses.
- Toys (Ecomaison): products for children under 14.
- Sports / DIY / Garden (Ecomaison): fitness gear, hand tools, non-motorised outdoor.
A Bluetooth speaker = packaging + WEEE + batteries. A clothing brand = packaging + TLC. An exercise equipment brand = packaging + sports/DIY (and WEEE/batteries if motorised).
Step 2 — Engage a France-established representative (Week 1, Day 1-3)
Non-EU sellers cannot register directly. The mandate is electronic, signs same day. See our mandataire REP guide for details on the role.

Step 3 — File eco-organism dossiers (Week 1-2)
Your representative files one dossier per stream:
- Catalog of your French SKUs with categories, weights, material composition.
- Annual sales estimate to France (revenue or units — rough estimates are fine).
- Company registration certificate (US Certificate of Good Standing or equivalent).
- VAT / tax identifier if you have one.
Filing review takes 5-10 business days per dossier.
Step 4 — IDU issuance and SYDEREP publication (Week 2-3)
Once approved, ADEME issues an IDU per stream and publishes on SYDEREP. Verify each IDU at syderep.ademe.fr before any marketplace upload. See our IDU verification article for the publication mechanics.
Step 5 — Marketplace upload (Week 3-4)
Upload IDUs to:
- Amazon Seller Central (Settings → Compliance → EPR).
- Cdiscount Seller Zone (Mon compte → Conformité environnementale).
- ManoMano back office (per category).
- Fnac/Darty Marketplace (compliance section).
- Shopify: no marketplace upload needed, but display Triman + Info-tri on packaging.
Listings reactivate within 24-72 hours of upload.
Step 6 — Labeling (ongoing)
French packaging labelling is a separate obligation:

Step 7 — Annual declarations (ongoing)
Each year by 28 February, your representative files declarations for the previous year’s French tonnage:
- Quantities per stream and per material type.
- Eco-contribution invoicing.
- Status updates on any changes (new SKUs, new markets, etc.).

For lower-volume brands ($200K-$500K French revenue), eco-contributions drop and total can be €10,000-€12,000 Year 1.
Common US-founder mistakes
Assuming a French subsidiary is required. It is not. A France-established representative handles it. See /blog/registered-french-entity-required-epr.
Confusing EPR with VAT. Separate regimes. EPR through your representative; VAT through a tax advisor.
Skipping batteries because they are "small." Coin cells, embedded lithium, USB-C rechargeable — all in scope.
Treating Triman/Info-tri as optional. They are required and there is a labeling malus on the eco-contribution if missing.
FAQ
I am incorporated in Delaware and ship to France from a Texas warehouse. Am I in scope?
Yes. Article L. 541-10 II applies on the basis of "first placing on the French market," not on the basis of producer location. A Delaware LLC shipping from Texas to French consumers is the producer for French EPR purposes. The fact that all your operations are in the US is the reason you need a France-established representative — direct French registration is not available to you.
I have French sales below $50,000/year. Is there an exemption?
No registration exemption based on revenue or volume. The eco-contribution scales down (low volume means low contribution), but the legal obligation to register exists from the first unit shipped. Marketplaces (Amazon France, Cdiscount) verify presence on SYDEREP regardless of seller scale.
Do I need French VAT registration in addition to EPR?
Possibly. EPR and VAT are separate regimes. You may owe French VAT through IOSS, OSS or a French VAT non-resident registration depending on your business model. Talk to a French VAT advisor in parallel with your EPR setup. EPR registration through a representative is independent of any VAT structure.
