Article L. 541-10-9-1 of the French Environment Code, created by law n° 2026-602 of 8 July 2026, requires any person subject to French EPR without an establishment in France to appoint a representative established in France by written mandate, and subrogates that representative into the obligations for which it accepts the mandate. The rule is horizontal: it applies to weee exactly as it applies to the other French streams, and it does not depend on the PPWR.
The test is establishment in France, not nationality, so a producer based elsewhere in the European Union is covered on the same terms as one based outside it. Within the scope and duration of the mandate we carry the weee obligations; you keep producer status, answer for the accuracy of the data you give us, and remain responsible for any period before the mandate took effect. How this stream works in France.
The WEEE (waste electrical and electronic equipment) stream covers all product categories defined under French law: temperature exchange equipment, screens, lamps, large and small equipment, small IT/telecom equipment, and photovoltaic panels. Ecosystem and Ecologic share the general market, while Soren is the dedicated eco-organism for photovoltaic panels (category 7). Marketplaces are legally required to verify that third-party sellers have a valid IDU before listing products in scope.

- The first company placing these products on the French market, with no revenue or volume threshold. Producers with no French establishment, EU or non-EU, selling electrical or electronic equipment to French consumers, including dropshipping and FBA sellers. A producer with no French establishment must appoint a mandataire, compulsory since 10 July 2026.

- Do I still declare in a year with no sales?
- Yes. The membership stays active and the declaration is filed at zero. Cancelling without ending the activity carries the same exposure as never registering: the IDU is removed from the SYDEREP register, and marketplaces that query it continuously delist accordingly.
