Do you ship physical products to consumers in France?
Cross-border D2C, Amazon FBA from any EU warehouse, Shopify, drop-shipping — all count.

Is your company established outside the European Union?
A US LLC, UK Ltd, Hong Kong company, Chinese 公司, Canadian Inc., Swiss SA — all non-EU.

Are you the first to place the products on the French market?
No French importer is taking title before you. If you ship direct to the consumer, the answer is yes.

Do you sell tangible goods (not pure services or software)?
Anything in a box, polybag, jar or bottle counts as packaging — the most universal EPR stream.

Do you expect to ship more than 200 units or €5,000 of revenue to France in the next 12 months?
Below very small thresholds enforcement is lighter, but the legal obligation still exists.
