1. Publisher

2. Scope of service
EPR Representative acts as a French Extended Producer Responsibility authorized representative under Article 8a §5 of Directive 2008/98/EC and the French Environment Code (L. 541-10 and following). The service is provided under a written civil mandate (French Civil Code articles 1984 et seq.).
The service does not include VAT compliance, customs services, corporate filings, product safety or CE compliance, intellectual property protection, or any service unrelated to French EPR execution.
3. Producer status retained
In accordance with the Conseil d Etat ruling of 10 November 2023 (case 449213), the appointment of an authorized representative does not transfer the producer status or the underlying obligations to the representative. The client remains the producer for all legal purposes.
4. Pricing and invoicing
Service fees are set out on the pricing page, structured as three published tiers per EPR stream (Light, Standard, Volume) plus an Enterprise tier on quote. The tier applicable to each stream is determined at mandate signature based on the declared annual volume in the stream's natural unit (UVC for packaging, pieces for textile, references for WEEE / furniture, tonnes for construction and paper) and is re-assessed at each annual anniversary. Although the recurring fee is published on a monthly basis, it is invoiced once per year, in advance, covering twelve consecutive months of service per stream. The setup fee is invoiced once, upon signature of the mandate. Multi-stream discount (−10% on the 2nd stream, −15% on the 3rd, −20% capped on the 4th and beyond) applies to the recurring fee only, not to the setup fee. Eco-contributions billed by the eco-organisms are passed through at cost on a separate invoice line. The client authorizes EPR Representative to advance eco-contributions and re-invoice them.
Invoices are payable within 14 days net of issue date (within the 60-day maximum set by Article L. 441-10 I of the French Commercial Code). Late payment triggers, without notice (Article L. 441-10 II): interest at three times the legal interest rate (taux légal × 3) plus the statutory €40 recovery indemnity per overdue invoice (Article D. 441-5). Additional recovery costs are reimbursed on production of supporting documents.
5. Timing and service levels
Marketing materials on this website reference standard turnaround times (2 to 3 weeks from signed mandate to IDU publication; 48 to 72 hours for the Priority Recovery add-on; 24 hours for written quote response, Monday to Friday CET). These are best-effort commitments on the portion of the workflow controlled by EPR Representative (dossier filing, eco-organism follow-up, client communication). Time elements outside our control — notably eco-organism review duration (typically 5 to 10 business days) and ADEME SYDEREP publication latency (typically 5 to 10 business days) — are excluded from the commitment. The Priority Recovery add-on accelerates our portion of the workflow but does not bind the eco-organism or ADEME to faster processing. No remedy attaches to a missed timing window unless a separate written SLA is agreed.
6. Client obligations
The client provides accurate product data (categories, materials, weights, volumes), valid company identification, and timely updates when the product mix changes. The client remains responsible for the accuracy of declared data.
7. Liability
EPR Representative acts with the diligence expected of a professional mandatary. Liability is limited to direct damages and capped at twelve months of service fees paid by the client. Indirect damages, lost profits, and reputational damages are excluded.
8. Termination
Each party may terminate the mandate with 30 days written notice. On termination, EPR Representative hands over registration data, IDU numbers, and open declarations to the client or to a successor representative. Termination does not relieve the client of accrued obligations.
9. Governing law and jurisdiction
These terms and the mandate are governed by French law. Disputes are subject to the exclusive jurisdiction of the courts of Paris, France, unless a mandatory consumer protection rule applies.
