Wherever you are based, the rule is the same since 10 July 2026: Article L. 541-10-9-1 of the French Environment Code (law n° 2026-602) makes appointing a France-established representative compulsory for anyone subject to French EPR without an establishment in France, and subrogates that representative into the obligations it accepts. The test is establishment in France, not nationality, so an EU company with no French entity is covered exactly like a seller from outside the Union. See our breakdown of the statute.

US brands selling into France through Amazon FR, Shopify, TikTok Shop, or any other channel have to designate a French EPR authorized representative. We are that representative, set up specifically for US producers shipping consumer goods into the French market.

Since Brexit, UK brands selling into France are treated as non-EU producers under French EPR law. The same way US or Chinese sellers do, you must appoint a French authorized representative for each EPR stream your products fall under.

Being in the EU changes nothing: the French mandataire obligation is triggered by not being established in France, not by being outside the EU.
