A France-established representative is now compulsory for medicines.
Article L. 541-10-9-1 of the French Environment Code, created by law n° 2026-602 of 8 July 2026, requires any person subject to French EPR without an establishment in France to appoint a representative established in France by written mandate, and subrogates that representative into the obligations for which it accepts the mandate. The rule is horizontal: it applies to medicines exactly as it applies to the other French streams, and it does not depend on the PPWR.
The test is establishment in France, not nationality, so a producer based elsewhere in the European Union is covered on the same terms as one based outside it. Within the scope and duration of the mandate we carry the medicines obligations; you keep producer status, answer for the accuracy of the data you give us, and remain responsible for any period before the mandate took effect. A fixed annual fee, stated in writing before you commit.
Per stream, for producers under the eco-organism flat-fee regime. Your exact fee depends on this stream's declarative regime and your number of product references, never on sales volume.
The quote states the fixed annual fee for medicines, the one-time setup for the stream and the refundable security deposit. For the twelve months it covers, the number you sign is the number you pay.

How this stream works in France.
The MNU stream (médicaments non utilisés) covers medicines for human use placed on the French market. Cyclamed is the sole approved eco-organism, running the long-established pharmacy take-back scheme for unused and expired medicines. The 2026 contribution is a very low per-box amount (about €0.0045 per box). Cahier des charges: arrêté of 29 October 2021. Pharmaceutical laboratories and importers are in scope.
